Legal Question in Consumer Law in North Carolina

bought 2003 honda accord in march. motor went bad. warrenty covered motor. took three weeks to come back. siill not running right. sent to dealership. that motor not good.another motor ordered.went to pick up things from car found tire slashed on one side.asked dealer to switch out car. no was the answer. have not had car for almost two months. do i have leagal options?

You bought a used car with a limited warranty, which the dealer has honored. The fact that the motor was no good and the fact that it took many weeks to arrive is not the dealer's fault unless this was somehow part of the agreement and I doubt that it was.

The tire slashed is another matter. Where was the car stored? If the dealer had control of it then the dealer had a duty to make it safe and see that it was not vandalized. See if the dealer will get you a free tire.

That really is not what you want though. I would see if you can trade the car elsewhere if you think its a lemon, but it does have a new motor in it. How is it running? If it now seems to be ok, then keep it. If your faith is shaken, get rid of it and just do not do business at this place ever again.

Before you buy a used car, get it thoroughly checked out by your own independent mechanic and make sure that you get a CarFax report before you buy. There are great used cars out there but you have to take precautions to protect yourself.

Car dealers are not insurers. Cars are mechanical and things do go wrong. I do not know how long you owned/drove the car before the motor went. Maybe it was just bad or maybe the dealer lied. However, if you can show that the car had a problem and that it was obvious enough for the dealer to know then, in that limited circumstance, you may have a case.

I am not a car mechanic. Talk to a car mechanic and see if you can learn what made the motor go bad and what, if any symptoms, the car would have exhibited at the time it was sold to you.
