Legal Question in Consumer Law in North Carolina
I purchased carpet from a local carpet installer 5 years ago. The carpet manufacturers warranty is 10 years on wear. If the manufacturer comes back and says they are not liable because the pad installed did not meet manufacturers requirements (which is my fear) and the carpet installer is now out of business. Can I go back to the owner of the carpet installation company and demand retribution?

It depends...lets take your assumption as fact. The warranty fails because the company messed up with the install. If the company was a corporation or other legal business entity, then you can only go after the company and not its owners. If it was not a registered business entity and was just a sole proprietorship, then you can sue the owner...but you have to keep in mind that there is a Statute of Limitations (laws that limit how far back you can go to sue people or companies) for your claim. You need to speak to an attorney to see if you can sue.
