Legal Question in Consumer Law in North Carolina

I recently decided to cancel the landscaping vendor that I've had for the last 3.5 years. He invoiced me for the entire year for cancelling our implied contract without cause. I did not have any contract except that he did the landscaping for a flat fee each month. He is now stating that he will take me to small claims court unless I pay. Am I legally bound to pay?

I don't know if there are any facts you haven't told me but based on what you have written, I would certainly not pay. If he sues, do not use words like "implied contract" in court - just tell the magistrate that you hired him each month and decided to cancel his services and there was never any contract or agreement between you in writing and you certainly never agreed to pay for an entire year.
