Legal Question in Consumer Law in North Carolina
what recourse do I have to get buyer of my refrigerator to pay rest of payments agreed upon on sales contract between us
1 Answer from Attorneys
Depends. Was there a written contract? If so, what are the terms and conditions relating to default or non-payment? Assuming the refrigerator cost was not more than $10,000 you could file in Small Claims Court in North Carolina but only if the buyer resides in North Carolina. And when you file you have to file in the county in which the buyer resides. There is the possibility that you could repossess the refrigerator but you really would need to consult a lawyer before you even think of doing this. In sum, you did not provide nearly enough information for a lawyer to give you a true answer to your question. You should contact a contract or debt collection lawyer at your earliest convenience.
