stopping a check a criminal offense?

I took a broken computer in for diagnosis to make

a ''junk or buy new'' decision. The manager said it

could be fixed, but then exceeded the sum I

originally told him I was willing to pay. Based on

his assurance it was now ''better than a new one''

I accepted it. When I got it home it was not fully

functional. Within 24 hours I told him the service

was unacceptable, I was returning the machine

which he could keep and stopping payment on

the check. He said he will prosecute me for

passing a bad check. Can he?

No. Passing a bad check means you write a check knowing you dont have funds in the account to pay it. he will have to take you to small claims court and your defense would be he didnt repair it as promised.
