if a child is born out of wedlock does the mother have all rights or do both parents have 50/50 rights?

Either parent has equal rights to the care, control and custody of the child regardless of marital status of the parents, absent any orders or agreements. The law in other states is different, but that is the rule here. See Rosero v. Blake, 357 N.C. 193 (2003) at:
