Legal Question in Credit and Debt Law in North Carolina

Got civil summons in concord, nc for a credit card debt, sept 24- last payment was little over a year ago. I am unemployed for the last 2 years, zero savings and only getting by on my wives paycheck. Trying to get legal aid but always busy so what should I do???

Nothing. If you have a lot of debt, you might want to consult a bankruptcy attorney and file bankruptcy. Bankruptcy can be filed even after judgment.

Otherwise, there is no wage garnishment in NC. When you get exemption papers, make sure that you fill them out properly or get legal counsel to assist.

If you recover financially, you can see about resolving the debt. Save money now, if you can. When you have approximately 50% of the judgment amount saved up (judgments earn interest at a rate of 8% per year so it will only get bigger), see if the creditor will accept it. If not, go higer, but not higher than 80% of the debt.

Get any agreements in WRITING before you pay out a dime.
