Civil Summons

Rec'd a civil summons for credit card debt. I'm sure I will receive several more as they were drivers fuel cards for our trucking co. We've nearly lost our company due to the economy and are down to only 1 truck. I agree that we owe the money but there is no way we can pay them all totaling $30,000+. Do I do anything at this time as I have no defense (except the economy)? Do I wait for a summary judgement on each? Exactly how bad is a summary judgement? We also had an 18 wheeler repo'd and will eventually get served for the balance of that loan. 19 yrs of perfect credit so we are totally lost and devastated. Any suggestions welcome.

You can always try to buy some time and negotiate the amounts down. File a motion for extension of time and ask for another 30 days to answer. If you can gather together any money, call the other side's attorney and explain your position. You have to get across that it will not be worth it for them to pursue it because there aren't any assets. Lot of creditors will take what they can get.

Also - if you are being sued in the name of the company and this is not in small claims court, you may be required to have an attorney represent you.
