Legal Question in Credit and Debt Law in North Carolina
Credit card debt
I had an attorney to call me about a credit card debt that is over 4 years old. He said that he was going to send a sheriff to the house and list all my assets which I really don`t have anything and make me sell it to pay off the card. I offered to pay 100.00 dollars a month and he said it was not good enough. I don`t know the status of my job from day to day for the company has filed bankruptcy. What can I do about this ? I`m really having a hard time making house payments etc. Please help me with this matter and give me advice . Thank you

Re: Credit card debt
Unless you have been sued and a judgment has already been obtained, nobody will execute on your property. Even if a judgment has been obtained, they are supposed to send you a notice of rights allowing you to list your assets and keep a certain amount from being executed on.
Consult an attorney to see if you have a judgment against you or not and also whether this attorney may be in violation of the fair debt collection practices act or ethical bar rules.
