Legal Question in Credit and Debt Law in North Carolina

Credit Card SOL

This morning I received a call out of the blue from a suposed law firm from Atlanta Ga. wanting to sue me over a credit card that they say I quit paying on in 2003.

My credit was harmed badly several years ago due to stupidity and there might actually be someone out there that I might still owe but, I have refinanced my house three times to clear up my mistakes and everyone that was on my credit report in 2003 was suposedly paid off.

Can they actually sue me or garnish my wages on this?

They are saying the bill was 6400.oo but will settle for 2800.oo as of now and wanted me to give them acount info over the phone right then. Also said if I do nothing they will be a total of over 8000.oo once they win in court.

I have their phone number and told them I would call them back on Monday.

What should I do?

Re: Credit Card SOL

If you do not think this is a valid debt, do not pay. Sure they can sue you but if this is not your debt or if the statute of limitations has expired, they cannot win. The main thing is that you need to defend any lawsuits and not ignore it. Do some research online on fair debt collection, send them a certified letter asking for validation of the debt, that you do not believe the debt is yours, that if it is yours, you believe the statute of limitations has expired and that you will pursue them for any violations of the Fair Debt collection practices act.
