Legal Question in Credit and Debt Law in North Carolina

Hi, i dated a guy for three years- he maxed out all of my credit cards, over the years i was a part of a debt settlement group- through which- all of the debtors were settled, except Citi Cards. It has been almost three years & citi never settled, and yesterday- i received a court summons for the account. the amount on the card was a little over $9,000. I'm not sure what to do- about this- in court... will i have to pay the total amount plus court costs/attorney fees?? what should i do? is there any way to get out of this?

thanks,

Julia

Assuming your boyfriend used the credit card with your permission and you never contested the charges, you probably can't can't get out of it for that reason. However, it is hard to tell just from what you say here.

You should file a written answer to the lawsuit to give yourself more time. Find an attorney to help. Your debt settlement company may be able to refer you to someone, or you can find someone local to you. (If you are still active with the debt settlement company you definitely need to tell them about this so they can help you). If you do not file the proper answer you will lose any legal defenses you may have and you might damage any claims you may have against the former boyfriend.

Your answer is due 30 days after you were served. This will give you time to try and find the money for a lumo sum settlement. IF you can't do a lump sum and you can't avoid liability, their lawyer will give you a monthly payment plan for 100% of the balance owed plus interest and attorneys fees.
