Legal Question in Credit and Debt Law in North Carolina

Debt Cancellation Notice

In early January 2008 I received a Form 1099-C Notice for Cancellation of Debt in the amount of $11445.07 dated for December 31, 2007. This notice was filed with my 2008 Incime taxes. Since that time Discover Bank has started sending me bills for that amount. I received some legal papers from a Law office which was hired by Discover Bank to collect the debt. A copy of the Debt Cancellation notice was faxed to the law office. Their reply was that Discover bank still intends to collect on this debt and will take me to court if necessary. Can they do that? Does the Form I received in the mail mean nothing?

Re: Debt Cancellation Notice

I don't know for sure without further research but if they sue, definitely raise it as a defense. Maybe they are just trying to intimidate you into paying.
