Debt collection

My Credit union has summoned me to apper in court concerning an unpaid debt of 6 months - I am currently unemployed full time (working 15 hrs per week) and unable to pay this debt along with many other debts. What will happen in court and what are my options?

If it a valid debt and you don't have any defenses, they will most likely get a judgment against you. This may include attorneys fees, costs and interest. You will have to review the complaint to see what relief they are asking for.

Once they get a judgment, they can try to execute. If you don't have much assets, they probably will be unable to collect. They would have to send you a Notice of Rights to designate any exemptions and you should make sure you fill that out or else you will be deemed to have waived your exemptions (all this would occur after a judgment has been rendered against you).

You may want to see if you qualify for legal aid and have an attorney review everything.
