Legal Question in Credit and Debt Law in North Carolina

I gave an ex friend two loans to help her purchase several items she ask my help to obtain. The first loan was in 2008 and the second one 2009. She has made some payments but they have not been regular. She resides in Houston, Texas but I reside in North Carolina. So can you tell me the process for suing her in small claims so I can attempt to get my money back. Thanks

You have to go to Houston, Texas to sue her in small claims. Talk to a Texas attorney regarding small claims or try http://www.courts.state.tx.us.

You may be able to sue in regular court in NC (assuming she resided in NC when she received the loans). However, do you have any documentation evidencing that this was a loan? Anything written on the payments? You are going to have a hard time proving your case without something in writing. And you may be running up against the statute of limitations - but I cannot advise you on a Texas law and you need to speak to a Texas attorney about that as well.
