Legal Question in Credit and Debt Law in North Carolina
judgement on old debt
I live in NC and was contacted by a collection agency for a $700.00 credit card debt from 2002. They are threatening legal action in the form of a judgement and wage garnishment. What can I do?

Re: judgement on old debt
If you last paid in 2002 and have a valid statute of limitations defense (would need more research and need to know specific facts), I would make notes of any more threatening calls - place, date, time, name, etc. . If they sue you and the statute of limitations has passed, you can defend on that basis and possibly even assert counterclaims for violations of fair debt collection practices act depending on the facts.
