we were late on 2 payments last year - in january we called and told them we nkow we are late we will pay some extra every month to catch up - now every month we get socked with a late fee which they say they will keep charging until we are caught up -- so our ''extra'' is just going down the drain on late fees. This is with Countrywide... is this legal - is there any way I can get the late charges off my billing -- I have been on time and sent extra every month since Jan 08... but to them they say we are still late. We will neer catch up =(

What you need to do is get in touch with the loss mitigation department and see if you can work something out. Otherwise, speak with an attorney. With the amount of homes going into foreclosure, Countrywide should be willing to work with you to remove these late fees and make everything fine going forward, especially if you are making your payments. You might need some help though in dealing with them. NC has a foreclosure project run through the Office of the Commissioner of Banks.
