Legal Question in Credit and Debt Law in North Carolina

My mother died. There are three adult children that inherited everything, including an 800,000 property with 5 units which are rented out. My sister Jane was in charge of estate and she took rent money and didn't pay bank so there is a foreclosure coming up in 2 weeks. First we ever heard of it. We should have been notified of this and we weren't so we suffer because only $480,000 is owed on property. Can we stop the foreclosure? We did not sign the note so the court says that we are not parties to foreclosure so that is why we got no notice before she finally just sent us this notice of foreclosure. Can we sue our sister to get her out of estate and keep house? Thanks.

You really need to consult with an attorney ASAP. Maybe you can negotiate with the bank about the foreclosure. You probably need to bring a petition to remove the executor.
