Legal Question in Credit and Debt Law in North Carolina

Motion for Application for Order Confirming Arbitration Award

I was served with the above type motion filed with the Clerk of Superior Court in Wake county, NC. This is for an arbitration I was not aware of that was conducted by the National Arbitration Forum for CACV of Colorado (debt that is outside the SOL). Should I have a motion to dismiss filed using the SOL as my defense or do I need to wait until they attempt to sue?

Re: Motion for Application for Order Confirming Arbitration Award

You need to respond to the motion and you probably want to consult with an attorney. I don't know whether you have a SOL defense or not since it seems like you already lost at arbitration. You may need to argue that you were never served with notice of the arbitration and you may also want to consult with an attorney in Colorado.
