Legal Question in Credit and Debt Law in North Carolina

NC Civil Summons now what?

My spouse received a civil summons from the sheriff today from CitiBank for the amount of 10,016 dollars. We are past due on paying the debt. My husband was a victim of identity theft (this debt is ours though), and Citi reduced our available credit limit, forcing us to be over the limit and our monthly payment skyrocketed as did the interest rate. We couldn't make the minimum payments so we were sending in as much as we could but they sent the account to collections anyways, we stopped paying any amounts to them once they sent it to collections. We don't own a house, we don't own anything not even a car, it's leased. What can they do? What should we do now????

Well - chances are they won't be able to collect. This will effect your credit of course. There may be counterclaims or defenses you can raise but you would need to consult with an attorney.
