Legal Question in Credit and Debt Law in North Carolina

I owe a friend 9000.00 and we never had anything in writeing. the only proof he has that he gave me money is 2 checks. I paid him 2000.00 and told him I would give more when I could. Now his lawyer is sending letters demanding $600.00 a mounth. I have 3 kids and my wife lost her job, so there is no way I can pay this. What can he do if I don't pay?

He can sue you. He can recover a judgment against you. I don't know what you own, how its titled or what assets you have, but he can try to collect on any judgment that he has.

Whether he will prevail or not is another question. I don't know how long it has been since you last paid on the loan. Your part payments may excuse the fact that there is no writing.
