Legal Question in Credit and Debt Law in North Carolina
I received a Magistrate Summons today for a small claim action from a school I attended. I was in a major car accident and was out of work and could not pay the loan.I did call and tell them was in the accident and could not pay at the time. I never heard anything from the school or from any company about money owed during that time. Now they want to take me to court for 3819.00.
I am lost as to how to proceed.

You should consult a lawyer regarding any possible defenses or methods of resolving this matter to your benefit. Ignoring it will likely lead to a default judgment and further headaches. Contact a debt collection defense attorney in or near your area for a consultation
You offer no really relevant details here. Who is suing? The school itself? Or a lender? If a lender, is this private or public? How long has it been since the money was owed? When is the hearing? When were you served? Did you file an an answer? I suggest that you follow up on Attorney O'Neal's advice and at least get a consult with an attorney to see whether it makes sense to litigate this or try and resolve this debt.
