Legal Question in Credit and Debt Law in North Carolina

I have recently had my bank acount garneshed by capitol one i need to know if they can take my only vehical? I am unemployed and just purchased the vehical used i havent even recieved the title back from dmv yet i was told the blue book value is some were around 2,500 dollars

If you had timely filed a notice of right to designate exempt property and declared your exemptions,your bank account would most likely not have been garnished. If the only money in there was from unemployment benefits, those are exempt. Your car probably is not worth enough for the Sheriff to hassle with. However, recently acquired property is generally not exempt from creditors.

Be sure to timely respond to any court notices and get legal help. Contact Legal Aid for starters. If you do not qualify, they can refer you to someone who can help. I suggest you contact Legal Aid about that garnishment. It may not be too late to get that taken care of.
