Legal Question in Credit and Debt Law in North Carolina
If you have a revolving credit card debt and cannot and are not making the payments; can the credit card company sue you?
1 Answer from Attorneys
Yes.
I don't know about your overall assets and debts. If you can't pay, you can't pay right now. But what do you want to do? Depending on your circumstances, you will do one of the following:
(1) do nothing at all if you are judgment proof and have exempt income and little or no assets;
(2) file bankruptcy if you have lots of debts/assets are relatively young and might be needing credit again in the future;
(3) try to resolve your debts through debt consolidation (go to www.nfcc.org and look for a non-profit agency nearest to you);
(4) try to resolve your debts through debt resolution.
If you try the last option, beware of the many scammers in the industry. Here is a link to a reputable debt resolution company: http://www.national-legal-center.com.
I would invite you to check them out.
If this is your only debt and you wish to resolve this, I do provide limited debt resolution assistance to North Carolina individuals. When you have sufficient funds to resolve the debt (at least 50% of whatever the balance is at the time of resolution) I can resolve your debt for a reasonable fee.
