Legal Question in Credit and Debt Law in North Carolina

sale of car

I sold a car to my neighbor, my husband talked me into doing it this way. We signed a contract for the sale of the vehicle (notarized) outlining the terms of the sale and the monthly payments. She has not been paying according to contract but she also has the title. Is there anything I can do to get the car back?

Re: sale of car

You can go to the magistrates court and sue her for return of the property. They have a form specifically for this purpose. Make sure to ask for her to return the title as well. Another alternative is to sue for money owed - secured (same court, different form). Without seeing your contract, I can't say which way would be better. You may want to pay a lawyer for a consultation in your local area as to which way is the proper way to proceed.

Next time, don't turn over the title until it is paid for, or record the title showing you as a lienholder, as if you were a bank.
