Legal Question in Criminal Law in North Carolina

I am 19 year old female, was diagnosed at age 7 with minor autistic behavior-autism (most likely misdiagnosed) for my mother to get SSI. Once I turned 18, SSI stopped. I am not incompetent and want to go to college to get a degree. My mother does not receive any money for me since I turned 18. I am in a serious relationship, maybe marriage, but the person I am in the relationship with is afraid to be intimate with me because he is afraid he could be charge with a crime. Can he be? and Can I move in with him without my mother being able to stop me legally? Thank you.

Generally, unless you have been deemed incompetent and your mother appointed as a guardian or some other such court order is in place, the age of consent for a sexual relationship is 16 and at 18 you are considered an adult and can make your own decisions free from parental interference (at least from a legal standpoint). However, you may want to check with a local attorney just to be on the safe side. If you typed this question, you seem competent to me but if there is something about you that leads the person you are in a relationship with to be concerned about having an intimate relationship with a 19 year old, it might be worth looking into before you decide to move in together.
