Legal Question in Criminal Law in North Carolina
Automobile fraud
I have an 11 year old complaint against me. I just found out about this. On an extended business trip, I rented a car & didn't notify rental company I needed it longer (they had my credit card so I didn't worry about it). Meanwhile I was moved to another part of Los Angeles so my phone was disconnected and the rental company couldn't notify me. They filed a complaint (in NC) but since I had been moved (my company moved me because I could not return while on this trip.) the complaint was never served. The rental car was returned and bill paid but complaint was never withdrawn. There never was any fraud intended or perpetrated. I only know about this because background check for a job came up with it recently. I do not have records of the rental and don't know what rental company it was that filed the complaint. I can't really afford to go to NC to handle this. I need direction. I do not want to go to NC and end up in jail but I am afraid I might if I pursue this. I also do not want this hanging over my head. Is there a way to handle this without a lawyer remotely from CA or do I need to travel to NC and get a lawyer to get this handled? I have a clean record and have never been to jail.

Re: Automobile fraud
You need to discuss this matter with an attorney in North Carolina. When you say complaint that sounds like a civil matter. If that is the case you would not face jail in the worst case. If a criminal complaint has been filed then you need to deal with it. There may be a warrant for your arrest in North Carolina. It is most probably just a simple matter to resolve. But waiting will not make the situation better.
