Legal Question in Criminal Law in North Carolina
My boyfriend is in the county jail. There are no restraining papers at this time. However, there are pending cases when there was a restraining order. They have continued his case for going on a year now. I have been to visit him. Nothing has been said to me. I wanted to know if by law I can go see him.

Are you saying he has been in jail for almost a year with no court hearing? Where is his attorney and/or why is he not out on bond? As to you visiting him - the fact that you have been doing it without incident seems to indicate that it is OK. If there is no restraining order or other court order preventing you from contact with him - you should be able to visit him in jail unless the jail itself has some reason to deny visitation. However, there is something about your story that just doesn't sound right. Wilmington is a fairly large city but not so large as for a county inmate to sit in the pokey for a year on the charges you mention and not make bail or have a trail. Either his attorney isn't doing their job or he has far more serious charges than mere violations of a restraining order or your idea of 'going on a year' is more like going on 3 months.
