Legal Question in Criminal Law in North Carolina
My boyfriend has 5 kids, the last 2 were twins (6 months old) his baby mother doesn't do anything for the children. He works 12 hour shifts, drives the 3 oldest to day care, feeds them, cleans them, cleans the house, does literally everything.. Their mom doesn't do anything for them although she lives with them too. Clearly my boyfriend is under a lot of stress. He came home & couldn't take it anymore & slipped up... He pinched the twins & left a bloody nose & bruised eye from throwing a vasaline bottle at them. He loves his kids, he's never hit any of the other three children, if you were to put them infront of their mom and dad all three kids would run and choose their dad over their mom. He just made a mistake. The twins were in hospital for a day.. They didnt have any broken bones and they didn't need any stitches. My question is, would this be a misdemeanor or felony & what do you think his sentence or penalty will be? (By the way we live in Charlotte, Nc).

Throwing a vasaline jar at a six month old baby is not a 'slip up' or a mistake. Accidentally dropping the vasaline jar on the baby is a slip up or mistake. Purposely throwing a vasaline jar at a defenseless six month old baby because he gots a bit of stress to deal with is child abuse and is something that should never happen ever under any circumstances what so ever. The penalty should be sever enough to insure it never happens again.
