Legal Question in Criminal Law in North Carolina
I got charged with controlled substances on jail premises while bonding out for a warrant for a failure to appear. This would be my first felony. I was In possession of one MDMA pill. But while being arrested the officer never said anything. Even though I know it’s not their job. I’ve had no knowledge of it and she could have charged me right then and there right??? But what is the consequences of just having one pill??? I can’t afford a lawyer. And the pill was given to me for me to take and I never taken it because I have no knowledge of what it was. I received it from someone I never met before.

The consequences are a felony and likely some jail time. This is basically the dumbest crime to be charged with. You were specifically asked if you had any drugs when you were booked (likely several times) if you had it at that time, you simply should have turned it in. If you got it from someone while in jail - that is even dumber. You should have refused to take it or thrown it away. None of the lame excuses you have made matter or even really make any sense. You'll likely get a court appointed attorney, maybe they can work something out to get this reduced for you or merged into whatever other charges you have pending. Best of luck.
