Legal Question in Criminal Law in North Carolina
Can I be charged if a 16 year old has sex with a 13 year old that claimed to be a 16 year old? And that state I am from is North Carolina where the age of consent is 16

The short answer is - yes! The state you are from is irrelevant - the laws of the state where the sex occurred will likely control. Besides even in NC a 16 year old would still possibly get popped for having sex with a 13 year old because what they tell you is irrelevant, the actual age is what's important.
