Legal Question in Criminal Law in North Carolina

Child Sexual Abuse

My husband has been in jail for the last 7 months for 1 count of rape and 3 counts indecent liberties with a child (my niece). Without going into details, he is innocent. There is no evidence other than the childs word. I hired a lawyer when he got arrested and he does not seem to be doing anything, he has had every hearing continued. I am really frustrated because I don't know what to do and what to expect from a lawyer. I would think that there would be some evidence of his help but there is none. Do I sit back and trust him that he is doing his job? I do not have too much of a choice because I have/am giving him all extra money that I have but if it is appropriate that I walk into his office tomorrow and demand answers-that is what I will do. I do not want to upset him and create more problems for my husband. This is a well established lawyer in a small town in NC.

Well, speaking in general here- you are not the client and the attorney really only has to answer to your husband. Even if you are paying the bill, which it sounds like you are. I would let the attorney do his or her job. This stuff takes time, so that is presumably why there have been a few continuances. BUt I wouldn't walk in to his office demanding answers. I fyou were to do that to me, I would demand that you leave........Attorneys have ethical obligations and those are to the client, not the payor! hope this helps
