Legal Question in Criminal Law in North Carolina

My daughter lives in another state, her step mom is trying to have her arrested for assault. My daughter was trying to block her step mom from getting to the hospital bed where her dying father was and they bumped each other. Can the step mom have my daughter arrested in civil court? She tried in domestic violence court and the case was dismissed.

Civil Court is for lawsuits...criminal court is for arrests. The step mother can attempt to go to the police and seek to have the daughter arrested but the District Attorney would have to decide to press charges.
