Legal Question in Criminal Law in North Carolina
On Dec 29 my husband and I were drinking, we got into a heated arguement, we shoved each other, I broke a kitchen chair by slinging it in the kitchen on the floor. I got scared and called the police. By the time they got there, we were calm, and told the officer that we didn't want to press charges. (Neither of us) The police officer arrested me, and took me to jail. I am a 35 year old paramedic with no prior anything, on my record. I don't even believe there is a ticket. In the copy of the police report I have, he says, "defendant named above unlawfully and willingfully did assault and strike (HUBBY HERE) by STRIKING HIM WITH A CHAIR." I have a court date of January 27th and I have no idea what to do or expect. They have supeona for my husband to appear as a witness. We are fine. My husband picked me up the next morning. I DID NOT hit my husband with a chair, and he will show witness to that. Do I plead "not guilty"? The officer pressed charges, and I don't understand! Please help me!!!
