Legal Question in Criminal Law in North Carolina
if you are driving someone elses car and you get pulled over by the police, and the car gets searched. During the search a needle is found if it is un-used then is it still considered drug paraphernalia if you do not have any medical reason to have the needle?

The simple answer is "No." In order for it to be a crime under the statute the State must prove that you possessed it with the intent to use it for illegal drugs.
