Depends on what type of "official" and/or where the crime was committed. Need more information.

It depends who you spit on and who the arresting party is. If you spit on the President of the United States it is a federal crime. If you spit on the guard at the county house of corrections, it is a state crime. I am sure that you will find out soon enough if either entity is pressing charges.
