Under NCGS � 14-90 there are two possible sentences depending upon the amount of money which is embezzled. If the value of the property is one hundred thousand dollars ($100,000) or more, the person is guilty of a Class C felony. If the value of the property is less than one hundred thousand dollars ($100,000), the person is guilty of a Class H felony. Under the sentencing statutes, assuming no prior record, the sentencing for a first offense under the lesser amount (the Class H felony) is presumed to be either probation or active time in the range of 5 to 6 months. If the amount is over $100,000. (the Class C felony) then the presumptive sentence is 53 to 78 months of active prison time.
