Legal Question in Criminal Law in North Carolina
Lawyer needed?
My brother is an inmate in a NC prison (I live in DC). He wrote to me and asked me to send flowers to a person at the prison (not an inmate) and to not talk about it on the phone. I did, not thinking it was illegal. He's in the hole and says the flowers were considered contraband. The prison listened to our conversation and said we used code, which we did because he told me it was a surprise. I thought maybe the person receiving the flowers was a phone monitor, so I said the ''garden has been planted'' to mean the flowers had been delivered. I'm wondering if I can be charged as an accessory or with introducing contraband into a prison. I have never been arrested and have no criminal record. I honestly thought I was not doing anything wrong. It never crossed my mind that I could get in trouble or would be breaking the law. I'm very worried.

I would doubt that you have anything to be concerned about as long as you don't go visiting your brother at his prison in North Carolina any time soon.

Well, distributing drugs ... i mean "flowers" over state lines could be a federal crime. But it would take more evidence than what youve described to convict.
