Hello, can a man be charged for 2nd degree arson just because they the last person in the house

Theoretically, anyone can be charged with anything. There is an old joke about indictments (which is virtually the same as being charged) by Chief Judge Wachler that goes,"You could indict a ham sandwich;" basically making fun of how incredibly easy it is to drag someone into a criminal charge.
