Legal Question in Criminal Law in North Carolina

PJC for misdeamenor larceny

I was wondering if it is at all possible to get a Prayer for Judgement for a misdeamenor larceny charge? I have never had one before. I had a deferred prosecution a few years ago, would that affect it at all? What happens afterwards if I can get a PJC?

Re: PJC for misdeamenor larceny

You can have your attorney approach the Assistant District Attorney and ask if (s)he would be amendable to a PJC. You would not know the answer to this until your court appearance at which time your atty could try to make such deal. It would probably be relevant what your prior offense is for (i.e. whether the offense for which you got Def Prosecution was also a larceny.) There are some creative things you can do to entice the ADA to agree to the PJC. Feel free to contact my firm to discuss hiring us for this misdemeanor.
