Legal Question in Criminal Law in North Carolina
My son was convicted of stautory rape when he was 17 yrs old in Davidson Co. He did not know how old the girl was, it turned out she was 12 at the time. He is now 21yrs old. He has no prior criminal record. I was not and still cannot afford a lawyer. Can he be released early? He was sentence to 12 to 15 yrs. I heart bleeds for him everyday to come home. Can anyone help???

Unless your son has a mental impairment that would cause him to not understand what he was doing there is no excuse for a 17 year old to have sex with a 12 year old girl. Any argument that the girl did not 'look 12' or 'consented' to the sex would simply carry no weight. If you or your son could not afford an attorney, one should have been appointed to represent him. While I sympathize for your loss, the bottom line is your 17 year old son had sex with a 12 year old girl. That is something that simply should not ever happen.
