Legal Question in Criminal Law in North Carolina

My son is going to court next month for his only DUI... no other offences... he blew a .08.. but not sure that alcohol was the only thing in his system. he is 22... he DOES not have money for court costs....what will happen if he cannot pay the day of court..

From your question, it sounds like your son is planning to waltz into Court and plead guilty to DWI without an attorney. If so, that is just flat stupid - there is just no other way to say it! At a .08 your son REALLY needs to consider the possibility of hiring an attorney and going to trial. A conviction of DWI has devastating and long reaching immediate and future effects especially with employment and pretty much anything else he may be interested in doing in the future. If there is even the slightest chance he could be found not guilty your son should take it (and at .08 - it is possible). However, to actually answer your original question, which the other attorney didn't, most likely, if he can not pay everything on the day of Court he will be placed on supervised probation and can make payments to them while he is on probation.
