Legal Question in Criminal Law in North Carolina
I got a ticket for misdemeanor larceny at Walmart in the amount of 81 dollars. I already have a dwi on my record and I was on the first offenders felony drug diversion program for another charge four years ago. The dwi was also in a different county four years ago and is the only thing on my record now. What are my options to have the charge removed from my record. I've never used a pjc but I just don't know if there is anyway I can get out of this. If charged I need the best possible outcome because I am a working college student. An attorney's job consists of two important components: 1) to zeaously represent the client and 2) to counsel. With regard to counseling, the best way 'out of it' is to not get in to it in the first place. Young people tend to make errors in judgment due to lack of life experience. When this happens, the appropriate response is to accept responsibility, deal with the appropriate punishment and learn from that experience and not repeat it. This is part of the natural maturing process. If you do that, you will likely go on to have a happy productive life and have valuable life lessons to share with your children and grandchildren. if not, your likely to have a life of these stressful and miserable types of brushs with the law. With regard to representation, I know of no judge who would straight up PJC a theft charge. However, you may be able to earn a PJC with some community service or you may be eligible for a defered prosecution program or perhaps even some other option. Each district has it own policies and standards, so it is best to consult with a local criminal attorney who will know what options and programs the judges and district attorney are comforable with in your district.
