Legal Question in Criminal Law in North Carolina
We have just been told to move out of our rental. Were in the process . We looked on facebook and saw that they went in when we were out and posted pictures of the inside.they gave us no notice didn't even tell us afterwards ... Can the landlord do that? I live in North carolina
1 Answer from Attorneys
Obviously they 'can' do it - the real question is whether it is legal. If you are currently under a valid lease, it is not legal and the landlord must get your permission to enter the property , unless there is an emergency situation or you agreed to it in your lease or if the landlord reasonably believed you had permanently left the property. However, this is a minor issue. The best way to stick it to a landlord is if you paid a security deposit - was that deposit placed in a trust account AND were you provided written notice of the the name of the bank in which it was deposited 99 out of a 100 landlords screw this up. Good luck to you!
