Legal Question in Criminal Law in North Carolina
My vehicle was searched last night while I was minding my own buisiness parked somewhere that I park every night after work and that other local police men gave me permission to be there. I gave them pemission to search, because I knew that it was clean. They gave me a ticket for less than a 1/2 oz of marijuana and a parphnelia charge. When I told them that I had no knowledge of such a roach in my center console, and asked to see the evidence. They said they would but then they got in their car and drove away. I had to drugs in my car. What do I do?

Get an attorney. Don't ever give permission to search. EVER. Don't ever answer any questions or 'tell your side of things'. Good 'ol 'Officer Friendly' isn't your buddy anymore when you get out of grade school. When an officer is asking you questions or requesting permission to search what that means is he doesn't have enough to charge or arrest you and he is hoping you will be dumb enough to provide it for him. If they have what they need to make an arrest, they aren't going to bother asking questions. When ever you are dealing with law enforcement - simply do not say anything at all. Not saying anything at all means - nothing - do not let any words what so ever come out of your mouth.
