Legal Question in Criminal Law in North Carolina
I violated a dvo 2 months ago. I am scitzoeffective and I am on a lot of medicine including high power antipsychotics. I had been out of my meds for 2 weeks when I violated. When they arrested me I was taken to the hospital and they didn't believe me when i told them I was scitzoeffective and on the paperwork I have it says I was in a drug induced psychosis. If I can show the court proof of my condition along with papers from my pharmacy showing I was out of medication at the time do you think it could help me from going to jail? The papers from the hospital show I was having a psychotic episode the night I violated. If I can show them that it is part of a condition I have and not drug use would it at least help me?

Its Schizoaffective Disorder. If you can show the violation was during a psychotic episode it may have some impact on the outcome. However, if who ever has the DVPO against you needs to be protected from you. having a mental disorder is likely going to be grounds for the Court to take action against you rather than excuse your behavior. Either way, you likely need an attorney - presenting complex medical evidence is likely not somehing you can competently do on your own. Best of luck.
