Gender Discrimination - What can I do?

I have suffered discriminating and harassing treatment from my manager and certain colleagues for 21/2 yrs. now. I�m subjected to derogatory comments and jokes, I am ridiculed for taking sick days due to allergies my son and I both have, as well as for the fact that I work outside of the home, rather than my husband. I am continually scrutinized, singled out and denied equal treatment and benefits that my co-workers receive. I�ve documented specific incidents. I am known throughout the company for my competence, skills and work ethics, however this seems to have no bearing on his discriminatory treatment towards me. I have made 3 verbal complaints to management but these have only aggravated the situation, leaving my manager hostile and vindictive towards me. It has been causing me immense anxiety and is affecting my work performance and healthy state of mind. I feel not that I need to file a formal complaint, but know there may be repercussions and would like to seek legal advice first. What my rights are and what recourse is available to me. I also would like to know how much harassment I am required to take before pursuing any legal action.

In California, you would be considered as having been constructively terminated in your employment. No one has to work in such a hostile employment situation, and, therefore, the courts have considered such an environment a termination. Giving rise to action for lost income, general damages and intentional infliction of emotional distress.
