Legal Question in DUI Law in North Carolina

After an accident, only one person involved, an person found in vehicle is going to court about three or four months DA to summon hospital records to charge said individual with DUI. How long can this go on before the defense ask for a dismissial in this case? The vehicle hydroplaned during a rainy evening, individual lost leg.
