Legal Question in DUI Law in North Carolina

I have a DVI charge, no arrest,no papers served it happen in oct 2009 just got test saying that i had a .08BAC can i still be charge if i was not caught driving?

You can be charged with dwi but you have a defense if no one saw you driving. The State has to prove beyond a reasonable doubt that you were driving (while impaired.) We can help! Good luck!
