Legal Question in DUI Law in North Carolina

I have to represent myself in court. My question is how can I get out of the Driving after consuming <21? I switched seats with my ex because he was plastered. I have documentation and recordings of him admitting that we switched seats and he was knowledgeable of the whole situation.
