Legal Question in DUI Law in North Carolina
Statue Of Limitations
Is there a Law pertaining to Drunk Driving or DUI charges that would be over 7 years old. Only charged and never appeared. Would this now be dismissed and if so would this person be faced with Failure To Appear Charges

There is no statue of limitations in this situation in NC, but there is a statue and cases requiring the state to allow you trials, which would be difficult for the state.

You better call the court where the DUI was pending and ask. Its possible that there could be a warrant for your arrest. They will not dismiss it simply because you didn't appear. Your free to call if you have any other questions. Robert Johnston (843) 828-1137
